BCI has taken view that remarks of Dave on the subject of appointment of Judges are baseless and reckless, and smack of a personal vendetta against CJI.

Bar Council of India (BCI) has issued a show cause notice to the Dushyant Dave, Senior Advocate and the Former President of Supreme Court Bar Association for his remarks against CJI Dipak Misra and Collegium.

BCI has asked him to file his reply within four weeks.

BCI has taken view that remarks of Dave on the subject of appointment of Judges are baseless and reckless, and smack of a personal vendetta against CJI.

Press Release issued by the BCI stated that, “Baseless comments of Mr. Dave on NDTV yesterday are an attempt to malign image of the judiciary and Institution. Personal Attack smacks of the some personal vendetta against Chief Justice of India which amounts to the gross misconduct”.

Senior Advocate Dave during his discussion on NDTV had said that,“Independence of the Collegium is only in name and the judges close to ruling executive had been rewarded earlier too.

He then made the allegations against CJI Dipak Misra which has now been taken note of by BCI.

Senior Advocate Dushyant Dave in his response has stated that,“I haven’t still got the notice and haven’t read it . But what I said on the NDTV is the truth.”

Dave further added that it is a matter of grave concern that conduct of judges go unchecked and the allegations against CJI Misra were very serious. In fact the BCI should have opposed Justice Dipak Misra’s appointment to highest judicial office to which only best and non-controversial person can be appointed. Allegations against him were serious and those holding the Constitutional offices should have been conscious and not appointed him.”

He concluded that,”He has nothing personal against the CJI Dipak Misra but allegations against him should be investigated”.
