- Criminal Procedure Code, 1973, Section 439 - Constitution of India, 1950 Article 21 Grant of bail - Detention in custody of under-trial prisoners for an indefinite period would amount to violation of Article 21 of the Constitution :- 1. Seriousness of the charge, one of the relevant considerations while examining the application of bail but it was not only the test or the factor and that grant or denial of such privilege, is regulated to a large extent by the facts and circumstances of each particular case. 2. Deprivation of liberty must be considered a punishment unless it is required to ensure that an accused person would stand his trial when called upon and that the Courts owe more than verbal respect to the principle that punishment begins after conviction and that every man is deemed to be innocent until duly tried and found guilty - Criminal Procedure Code, 1973, Section 439 - Prize Chits and Money Circulation (Banning) Act, 1978, Sections 4 and 6 - Indian Penal Code, 1860 Section 420 Chit Fund scam of Rs. Ten thousand crores - Accused released on bail on medical grounds.

- Criminal Procedure Code, 1973 Sections 397 and 228 Quashing of charge sheet :- 1. It is not only difficult but is inherently impossible to state with precision such principles. 2. The power to quash charge sheet be exercised in the rarest of rare cases. 3. Court may interfere if the allegations are so patently absurd and inherently improbable that no prudent person can ever reach such a conclusion. 4. No meticulous examination of the evidence is needed for considering whether the case would end in conviction or not a the stage of framing of charge or quashing of charge. 5. Where the offence is even broadly satisfied, the Court should be more inclined to permit continuation of prosecution rather than its quashing at that initial stage. - At the stage of framing of a charge, the Court is concerned not with the proof of the allegation rather it has to focus on the material and form an opinion whether there is strong suspicion that the accused has committed an offence, which if put to trial, could prove his guilt.

- Constitution of India, 1950 Article 243Q(1) U.P. Industrial Area Development Act, 1976, Sections 2(d)& 21-A - Claim for exemption from any taxes under the U.P. Kshetrya Panchayat and Zila Panchayat Adhiniyam, 1961 for the petitioner industries falling in an industrial area where no Panchayat is to be constituted - Held that, High Court rightly held that exemption under Section 12-A of the 1976 Act was not available in the industrial area not notified as an Industrial Township - Section 12-A specifically contemplates issuance of notification under Article 243-Q(1) and exclusion from Panchayat area is consequent and dependent upon such notification.
