Petition claimed Payal was converted to Islam under coercion and that her marriage papers are forged.
On Tuesday, the Rajasthan High Court ordered the release of 22 years old Aarifa, earlier Payal Singhvi, from a govt. home & allowed her to go to her husband but said that probe into her conversion and marriage documents would continue.
The bench of Justice Gopal Krishna Vyas & Justice Manoj Kumar Garg said they’d hear the merit of the conversion on the basis of the reply from the state govt. on Wednesday.
Last week, the HC had raised questions about the woman’s conversion to Islam & her interfaith marriage.
The HC had asked the state govt. that if there was any law or procedure in Rajasthan that governed religious conversions & observed that people could not change their religions based on an affidavit.
This case was a virtual re-run of a similar recent case in Kerala.
In May 2017, the Kerala HC had annulled the marriage of 24 years old Hadiya, earlier known as Akhila, to Shafin Jehan after her father alleged that her conversion was part of a larger racket to recruit terrorist operatives.
The Apex Court has raised questions about the HC order & has summoned Hadiya a doctor on 27th November.
Activists have repeatedly alleged that woman was being tortured at her father’s home & that her Fundamental Right to religion was being violated.
Rajasthan High Court’s hearing petition filed by Chirag Singhvi, who alleges that his sister Payal Singhvi was converted to Islam under coercion & that her marriage papers are forged.
High Court had raised doubts about Aarifa’s wedding to a Muslim man identified as Faiz Modi, & said the documents she produced, including a nikahnama (Islamic marriage certificate) contradicted each other.
