Law Commission had recommended stringent disciplinary action against lawyers disrupting court work.
Government has told Lok Sabha that the Bar Associations across the Country, including one in Supreme Court, had opposed Advocates (Amendment) Bill, 2017.
Government further added that lawyer bodies also oppose Law Commission’s 266th Report which has recommende the stringent disciplinary action against the lawyers disrupting the court work, including barring them from practising.
The Law Commission has recommended amendments to the Advocates Act, 1961 to allow lawyers a day’s token strike in the compelling circumstances with prior approval of the Bar Council concerned.
It also suggested that appointment of the eminent persons outside legal profession as the members in a proposed statutory body to deal with the disciplinary proceedings against the advocates.
P P Chaudhary,Minister of State for Law stated that Law Ministry had sought comments of Bar Council of India and all the State Bar Councils, besides the Bar Associations of SC and all the High Courts on Commission’s recommendations.
