Nine High Courts have opposed All-India Service for lower Judiciary, only Two supports it

9 HCs have opposed the proposal to have an All-India service for the lower judiciary & only 2 High Courts have supported this idea, a Law ministry document says.

The document sent to all the members of the parliamentary consultative committee on law & justice, also states that most of the 24 HCs want control over subordinate judiciary.

Narendra Modi led govt. has given a fresh push to long-pending proposal to set up the new service to have a separate cadre for lower judiciary in India.

This idea was 1st mooted in the 1960s.

As per the document, the HCs of Bombay, Andhra Pradesh, Delhi, Gujarat, Madhya Pradesh, Karnataka, Patna & Punjab and Haryana “haven’t favoured the idea of All-India Judicial Service (AIJS)”.

Document said only the HCs of Sikkim & Tripura have concurred with proposal approved by the committee of secretaries for formation of an All-India service for the lower judiciary.

Allahabad; Chhattisgarh; Himachal Pradesh; Kerala; Manipur; Meghalaya; Orissa & Uttarakhand HCs have suggested some changes in age at induction level, qualifications, training & quota of vacancies.

“Most of the HCs want the administrative control over subordinate judiciary to remain with the respective HCs,” it said.

The high courts of Jharkhand and Rajasthan have indicated that the matter is under consideration, while no response has been received from the HCs of Calcutta, J&K & Gauhati.

While seeking to overcome the divergence of views, the govt. had recently suggested to the Apex Court various options, including a NEET-like examination, to recruit Judges to the lower judiciary.

 

At present, high courts & state service commissions hold exams to recruit judicial officers.
