Justice Sapre dedicated 24-pages separately in the 547 pages judgement.
Right to Privacy of an individual is a natural, cherished, inseparable and the inalienable right which is born with a human being and extinguishes with it, Supreme Court.
Justice Abhay Manohar Sapre, who was part of the Apex Court’s 9 Judge Bench who has written a separate but concurring judgement declaring Right to Privacy as Fundamental Right under Constitution, expounded that it cannot be conceived that an individual enjoys a meaningful life with the dignity, without such a right.
Justice Sapre further enunciated that, “Right was not absolute and was subject to the certain reasonable restrictions which State was entitled to impose”.
He added that, “Right to privacy was one of those cherished rights which every civilised society recognises in the every human being”.
Justice Sapre in his 24 page judgment “In my considered opinion, the right to privacy of any individual is essentially a natural right, which inheres in every human being by birth. Such right remains with the human being till he/she breathes last. It is indeed inseparable and inalienable from human being. In other words, it is born with the human being and extinguish with human being”.
While quoting Preamble of Constitution, he stated that he does not find any difficulty in tracing Right to Privacy emanating from two expressions,”liberty of the thought, expression, belief, faith and the worship” and “Fraternity assuring dignity of individual”.
