SC expounds: States are under obligation to compensate victims of violence by Cow Vigilante Groups without Judicial Order.

Apex Court enunciated that States must frame the Schemes to compensate the victims of the crime, including those of the cow vigilantism as envisaged by Code of Criminal Procedure.

On Friday, Apex Court’s Three-judge Bench headed by CJI Dipak Misra further added that,“We do not have to say that All the States are under an obligation to compensate the victims of the cow vigilante violence. At the same time, the law and order has to have primacy and anyone violating must be dealt with sternly”.

SC was hearing a petition by the Congressman Tehseen S Poonawalla and Activist Tushar Gandhi who sought direction to the States to check the cow vigilantism.

Senior Advocate Indira Jaising, appearing for Activist Tushar Gandhi, sought a scheme for those victimised by the law-breakers.

Senior Advocate Jaising and Kapil Sibal raised the cases of Pehlu Khan who was killed in Rajasthan and submitted that far from getting the justice, kin of the victims were being harassed through the counter-cases.

Court has asked the States and thte Union Territories to comply with its September 6 order to appoint the Nodal Officers by October 31 to deal with the Cow Vigilantism.

  1. Why not apex court finalize some guide lines to compensate victims of unfair judicial dispensation for delays and patently incorrect judgments and constitute a high power committee as regards corruption charges etc.
