SC raps Centre, States on Food Security Law: We can only feel sorry for the People

What use is a law passed by the Parliament if States not implement it, asks Apex Court.

Supreme Court in its pointed out that,”We can only feel sorry for people of Haryana”.

Apex Court was speaking about How State Food Commission, set up under National Food Security Act in Haryana, has been sitting “jobless” and “without the proper infrastructure” owing to State Government’s lacklustre response to four-year-old welfare legislation.

Judgment by Apex Court’s Bench comprising of Justice Madan B. Lokur and Justice N.V. Ramana also listed nine other States Madhya Pradesh, Karnataka, Andhra Pradesh, Telangana, Maharashtra, Gujarat, Jharkhand, Bihar and Chhattisgarh.

States had all come under SC’s scanner for their damp response to food security law meant to help those living below poverty line.

Supreme Court expounded that, “Centre cannot look other way, passing buck on to States for not implementing the law. Referring to the Article 256,Constitution. Government of India cannot plead helplessness in requiring the State Governments to implement the Parliamentary laws”.

 

Supreme Court has directed Government to frame the rules and designate the independent officials for a Grievance Redressal Mechanism under Act within a year.

Court has further directed States to set up State Food Commissions and Vigilance Committees in every State by end of the year and set up a Social Audit Machinery.

National Food Security Bill was passed by the both Houses of the Parliament and received assent of President on September 10, 2013. Almost four years have gone by but Authorities and the bodies mandated to be set up under National Food Security Act, 2013 have not yet been made functional in some of the States.
