Today Senior Advocate Indira Jaising made some important submissions in the Apex Court relating to compensation of rape victims.
Submissions were made in a plea filed by Sr. Adv. Indira Jaising seeking details of compensation & other measures undertaken by States under Section 357A of the Code of Criminal Procedure.
Jaising, who’s also the Amicus Curiae in the case, today told the SC that actual disbursement of compensation money wasn’t happening.
Further, she submitted that because of the non-uniformity in the schemes framed by different States, there’s huge difference in money awarded to rape victims in different States.
She further added that the compensation wasn’t being disbursed till conviction of the accused, thereby defeating the object of the victim compensation scheme.
Interestingly, Indira Jaising also raised the issue of Centre washing its hand off such important matters.
“Standard argument by Centre is that law & order is a State matter; that’s the answer I get in all the Courts”, said Jaising while pointing out the duty of Centre under Article 256 of Constitution of India.
Bench comprising Justice Madan B Lokur & Justice Deepak Gupta took serious note of her submissions & quizzed the Centre on state of affairs.
Justice Deepak Gupta remarked “Money isn’t being disbursed. Forget whether Amicus has assisted you or not, that doesn’t absolve you of your responsibility.”
The Centre was also cornered on the fact that there’s no clarity on which Ministry or Dept. is actually responsible for victim compensation.
The Court proceeded to give time to the Centre to respond on these issues raised by the Amicus & adjourned the matter.
