Supreme Court refuses to stay Rajasthan Government Bill on OBC Reservation

Apex Court Bench directed that No decision be taken which would take the total reservation beyond 50 per cent.

Supreme Court has refused to stay Rajasthan Govt’s Bill on the reservation for Other Backward Castes (OBC) but has stated that Authorities should ensure that no decision was taken that could result in crossing total reservation beyond 50 per cent.

Apex Court Bench comprising of CJI Dipak Misra and Justice A M Khanwilkar and Justice D Y Chandrachud set aside November 9,2017 order of Rajasthan HC by which it had stayed OBC Reservation Bill, 2017.

SC Bench expounded that,”In our considered opinion, order passed by High Court staying legislative process is totally uncalled for and, therefore, that part of impugned order is stayed”.

SC directed that,”As we intend to remit the matter to HC, the said direction shall remain in force till writ petition is finally disposed of”.
