Supreme Court: State stands on position of a loco parentis to citizens and when there are so many deaths of the farmers in State of Tamil Nadu, it becomes obligatory on part of State to express the concern and sensitiveness to do needful.
Holding that the Government cannot be allowed to be insensitive towards plight of drought-hit farmers who commit suicide, Supreme Court expounded that State must take the necessary steps to grant relief to them.
Apex Court Bench comprising of Justice Dipak Misra, Justice A M Khanwilkar and Justice M M Shantagoudar pulled up Tamil Nadu Government for its failure to come to rescue of farmers who are suffering due to thefamine in State and sought explanation on the steps taken by it to address agrarian problem.
Supreme Court enunciated that,”State stands on position of a loco parentis to citizens and when there are so many deaths of the farmers in State of Tamil Nadu, it becomes obligatory on part of State to express the concern and sensitiveness to do needful and not allow impecunious and poverty stricken farmers to resign to their fate or leave downtrodden and poor to yield to idea of fatalism”.
SC further added that,”State, as guardian, is required to see how to solve these problems or to meet problems by taking the curative measures treating it as a natural disaster. Silence is not an answer”.
