Supreme Court yet again declines to grant Bail to Justice Karnan

Vacation Bench added that it could not override order of Seven-Judge Bench.

Apex Court Vacation Bench comprising of Justice D.Y. Chandrachud and Justice S.K. Kaul expounded that Court was bound by order of Seven-Judge Bench in this case.

Justice D.Y. Chandrachud and Justice S.K. Kaul enunciated that,”Court was bound by order of Seven-Judge Bench on the case and retired judge Karnan arrested on Tuesday after being on run for more than a month should mention matter before Bench of the Chief Justice. Thus only Special Bench could hear the plea”.

Appearing on behalf of Karnan, Advocate Mathew J Nedumpara submitted that this court had all the powers and should grant interim bail till reopening of the court.

Justice (retd.) C S Karnan, who was evading the arrest since May 9,2017 was arrested by West Bengal Police from Coimbatore on Tuesday.

Justice Karnan had written to Prime Minister. He retired on June 12,2017
